Unser Statement
Öffentliche Stellungnahme der IDDA GmbH zum OLG-Hamm-Beschluss und zur aktuellen Situation im RSTC Europe

Am 14.06.2025 hat das Oberlandesgericht Hamm in seinem Beschluss klar und deutlich festgestellt, dass der Ausschluss der IDDA GmbH aus dem RSTC Europe rechtswidrig war – sowohl in formeller als auch in materieller Hinsicht, insbesondere wegen des Fehlens eines tragfähigen Ausschlussgrundes.
Der RSTC wurde verpflichtet, der IDDA GmbH alle Mitgliedschaftsrechte vollumfänglich zu gewähren.
Das Gericht betonte unter anderem:
„Der Ausschluss der Antragstellerin [IDDA] aus dem Antragsgegner [RSTC] ist bereits wegen Verfahrensmängeln unwirksam. (…) Die Antragstellerin wurde weder angehört noch wurde ihr rechtliches Gehör gewährt. (…) Die gegen sie erhobenen Vorwürfe bleiben insgesamt unspezifisch und unbewiesen.“
Darüber hinaus stellte das OLG Hamm fest:
„Selbst wenn die vorgebrachten Vorwürfe inhaltlich zuträfen, rechtfertigten sie keinen Ausschluss.“
Die Entscheidung basiert auf einer umfassenden schriftlichen Prüfung, einschließlich einer ausführlichen Stellungnahme des RSTC.
Eine mündliche Verhandlung war aus Sicht des Gerichts nicht erforderlich, da die Sach- und Rechtslage eindeutig war.
Unsere Haltung
Die IDDA GmbH steht für Transparenz, Fairness und eine positive Entwicklung des Tauchsports.
Wir schätzen das Engagement vieler Partner, Ausbilderinnen und Ausbilder sowie Basisbetreiber – unabhängig von ihrer Verbandszugehörigkeit.
Uns ist bewusst, dass es in der Branche unterschiedliche Auffassungen und Interessen gibt.
Unser Ziel ist es nicht zu diskreditieren, sondern dort, wo es notwendig ist, strukturelle Rahmenbedingungen kritisch, aber konstruktiv zu hinterfragen.
Was bisher geschah – und warum wir jetzt informieren
Seit dem Gerichtsbeschluss sind folgende Punkte festzuhalten:

Die IDDA GmbH ist Mitglied des RSTC Europe – mit allen Rechten.

Der RSTC hat bis heute keine öffentliche Richtigstellung vorgenommen.

In sozialen Netzwerken kursieren weiterhin veraltete oder unzutreffende Aussagen über unseren Status.

Ein Angebot der IDDA GmbH, die Situation einvernehmlich und ohne öffentliche Eskalation zu klären, wurde vom RSTC abgelehnt.
Wir sehen uns daher gezwungen, selbst aufzuklären – nicht, um zu spalten, sondern um Vertrauen zurückzugewinnen.
Ein Appell an alle Beteiligten
Strukturen wie der RSTC spielen eine wichtige Rolle im internationalen Tauchsport.
Sie verdienen Vertrauen – und dieses Vertrauen erfordert Unabhängigkeit, Sorgfalt und Verantwortungsbewusstsein.
Wir hoffen weiterhin auf eine konstruktive Zukunft im Dialog –
für den Tauchsport, für die Ausbilderinnen und Ausbilder – und für die Taucherinnen und Taucher, um die es letztlich geht.

We are an internationally recognized diving association which offers RSTC certified diving licenses and teaching materials. However, we are much more than just the „license center of diving“.
We cooperate with dive centers and instructors in all business aspects and offer support in all areas that the sport of diving and the entire management behind it entails. We help with equipment, building a presence (online as well as offline) and all other problems that may arise in the course.

No important people are described here, because you are the most important to us. Everyone has his strengths and to use them correctly is our strength. Our motivated team, which is always supplemented, takes care that we provide a good service as a partner of diving and support you in the best possible way.
